Employer Requirement

Certain criteria must be met by an employer to be eligible to provide a job offer to applicants under the International Student Stream.
  • Business Existence: The employer must have been in active business for a minimum of 3 years prior to application submission. Additionally, since the applicant will be working in Ontario, the employer must have an office located within the province.
  • Compliance: The employer should have no orders issued against them under the Ontario Employment Standards Act, 2000, or the Occupational Health and Safety Act.

The employer must also meet specific revenue requirements for the most recent tax year, depending on the location in Ontario:

  • For employers within the Greater Toronto Area, a minimum gross revenue of $1,000,000 annually is required.
  • For employers outside the Greater Toronto Area, a minimum gross revenue of $500,000 annually is required.

The employer should have a minimum of five full-time Canadian citizens or permanent residents if located within the Greater Toronto Area (GTA).

Conversely, if situated outside the GTA, the requirement is a minimum of three full-time employees.

The completion and signature of the Employer Form by the employer serve as crucial proof of the applicant’s lawful employment and position within the company. Once completed and signed, the applicant must scan and upload this form with their application.

  • The primary location of their manager or supervisor.
  • The primary location of the office from which the applicant will receive assignments.

Application Process

Expression of Interest (EOI) Submission

Eligible applicants can submit an Expression of Interest (EOI) through the OINP’s e-Filing Portal. The EOI allows candidates to express their interest in applying for nomination. Profiles are assessed and ranked based on an OINP points-based system.

Invitation to Apply (ITA)

Candidates with the highest-ranking EOIs may receive an Invitation to Apply (ITA) during one of the OINP draws. Once issued, the applicant has 14 calendar days to submit their application for nomination.

Application for Nomination

Upon receiving an invitation, applicants must complete and submit their application for nomination to the OINP. The province will review the application and make a decision based on eligibility criteria.

Confirmation of Nomination

If the application is approved, Ontario will notify the applicant of their selection for provincial nomination. This notification will be sent to the applicant’s ONe-Key account within the e-Filing Portal.

Federal Permanent Residence Application

After receiving provincial nomination, applicants must submit a federal application for Canadian permanent residence. This involves completing and submitting an online application from IRCC Permanent Residence Portal.

Processing Time

Paper-based PNP applications for permanent residence are typically processed within 18 months. Applicants should monitor the status of their application and adhere to any additional requirements communicated by the immigration authorities.
