Eligibility Requirement for the OINP Employer Job Offer – Foreign Worker Stream
- 1.Expression of Interest (EOI) and Invitation to Apply (ITA): You must create an Expression of Interest and receive an ITA from the OINP to apply for provincial nomination.
- 2.Legal Status: If applying from within Canada, you must be a temporary resident with a valid work permit or study permit. You must maintain your permit and legal status until nominated.
- 3.Valid Job Offer: You must have a valid job offer from an eligible employer in Ontario to qualify for the OINP Foreign Worker Stream.
- 4.Licensing: If your job offer requires a license or authorization, you must possess it.
- 5.Work Experience: You must have at least 2 years of work experience in the last five years, equivalent to 3120 hours of paid full-time work in 24 months. The experience must be in the same NOC code as your job offer.
- 6.Part-time Work: If working part-time, it should be for at least 15 hours per week, totaling 3120 hours over four years, and in the same NOC code as your job offer.
- 7.Canadian Work Experience: Canadian work experience is eligible if gained legally while residing in the country.
- 8.Equity Ownership: Neither you nor your family members should have any equity in your employer’s business unless gained as part of your remuneration, in which case it should be less than 10 percent of total equity.
- 9.Intent to Reside in Ontario: You must demonstrate plans to live in Ontario after obtaining permanent residency by showing ties to the province such as working, applying for jobs, leasing or owning property, having personal or professional relationships, studying, visiting, or volunteering.
- 1.Full-time and Permanent: The job must be full-time (1560 hours/year or 30 hours/week) and permanent, with no end date.
- 2.Labour Dispute: The job offer must not impact the job of anyone involved in a labour dispute.
- 3.Wage Requirement: The wage offered must meet the median wage for the occupation in the Ontario region where the job is located.
- 4.Current Remuneration: If already employed with the same employer and in the same position, your current remuneration must be equal to or greater than the job offer.
- 5.Location: The job must primarily be in Ontario.
Employer Requirement
- Business Existence: The employer must have been in active business for a minimum of 3 years prior to application submission. Additionally, since the applicant will be working in Ontario, the employer must have an office located within the province.
- Compliance: The employer should have no orders issued against them under the Ontario Employment Standards Act, 2000, or the Occupational Health and Safety Act.
The employer must also meet specific revenue requirements for the most recent tax year, depending on the location in Ontario:
- For employers within the Greater Toronto Area, a minimum gross revenue of $1,000,000 annually is required.
- For employers outside the Greater Toronto Area, a minimum gross revenue of $500,000 annually is required.
The employer should have a minimum of five full-time Canadian citizens or permanent residents if located within the Greater Toronto Area (GTA).
Conversely, if situated outside the GTA, the requirement is a minimum of three full-time employees.
The completion and signature of the Employer Form by the employer serve as crucial proof of the applicant’s lawful employment and position within the company. Once completed and signed, the applicant must scan and upload this form with their application.
