Apply for Permanent Residency

There Are Two Options for Employer

LMIA

Employers can apply for a Labour Market Impact Assessment (LMIA) to get approval from Employment and Social Development Canada to hire foreign workers. This LMIA process is part of Canada’s Temporary Foreign Worker Program.

LMIA Exempt Work Permit

Employers can hire foreign workers without a Labour Market Impact Assessment (LMIA) if the job qualifies for an LMIA exemption. In such cases, employers can submit an employment offer directly through the Employer Portal. This process of hiring without an LMIA is managed under the International Mobility Program.

Two Options to Hire/Retain Employees

To hire foreign workers in Canada, employers must apply for a Labour Market Impact Assessment (LMIA) through one of five available LMIA streams.
  • Low-Wage Stream: For positions in low-skilled occupations.
  • High-Wage Stream or Dual Intent Stream: For highly-skilled foreign workers or to provide a valid job offer/support for permanent residence.
  • Agricultural Stream: For hiring farm workers.
  • Seasonal Agricultural Stream: For hiring seasonal farm workers from specified countries.
  • Global Talent Stream: To fill positions in tech occupations or unique and specialized roles.

Under any of the above LMIA streams, employers will be required to prove that they genuinely need to fill the requested positions, have an operational business in Canada, are financially able to fulfill the terms of a job offer, and could not find qualified Canadians or permanent residents for the job.

Several streams allow employers to hire foreign workers without requiring a Labour Market Impact Assessment (LMIA). These LMIA-exempt categories typically fall under the International Mobility Program and include:
  • North American Free Trade Agreement (NAFTA) and Other Free Trade Agreements (FTAs): This allows citizens from countries that have a free trade agreement with Canada (like the United States, Mexico, and other CUSMA or CPTPP member countries) to work in Canada under certain conditions.
  • Francophone Mobility Program: This allows hiring foreign French-speaking workers to fill high skilled and low skilled occupations and positions outside Quebec.
  • Intra-Company Transferees: Employees of multinational companies who are being temporarily transferred to the Canadian division of their company.
  • International Experience Canada (IEC): Provides youth from participating countries the opportunity to work in Canada temporarily.
  • Provincial Nominee Programs (PNP): For individuals who have been nominated by a Canadian province or territory to immigrate to Canada.
  • Canadian Interests – Significant Benefit: For people whose work will bring significant social, cultural, or economic benefits to Canada (e.g., unique skills, knowledge).
  • Canadian Interests – Reciprocal Employment: Allows foreign workers to work in Canada when Canadians have similar reciprocal work opportunities abroad.
  • Canadian Interests – Charitable and Religious Workers: For workers in positions that serve a charitable or religious purpose.
  • Research-Related Exemptions: Includes researchers working on projects at Canadian post-secondary institutions or affiliated research institutions.
  • Post-Graduation Work Permits (PGWP): Allows international students who have graduated from a participating Canadian post-secondary institution to gain Canadian work experience.
  • Spouses/Common-Law Partners of Skilled Workers and International Students: For spouses or common-law partners of skilled foreign workers or international students in Canada, enabling them to work in Canada.
  • Bridging Open Work Permit (BOWP): For individuals who have applied for permanent residence in Canada and are waiting for a decision.
